Terms of Sale and License
Version 1.0
In short: Wave X is free. Wave X Pro is a one-time purchase that unlocks Pro on one Mac. You can get a full refund within 14 days. Nothing in these terms takes away rights that consumer law gives you and that can’t be excluded.
1. Who we are and who sells Pro
Wave X is made by Frooty Labs (“we”, “us”). Contact: support@wavex.live.
Wave X Pro is sold by Polar, which acts as merchant of record and authorized reseller: Polar runs the checkout, takes payment, charges and remits sales tax or VAT, and issues your receipt. Your purchase is also governed by Polar’s buyer terms, which you accept at checkout. We license the software to you and provide product support.
These terms apply when you download or use Wave X, and when you buy Wave X Pro.
2. The license
Wave X is free to download and use. We grant you a personal, non-exclusive, non-transferable license to use it on Macs you own or control.
One Wave X Pro license unlocks Pro on one Mac. It can’t be shared or moved to a different Mac. If that same Mac is erased or repaired, you can use one self-service recovery (choose Need Help? when you enter your key). After that, contact support, who can restore Pro on that same Mac. A different Mac, including one that replaces a lost, broken or sold Mac, needs its own license.
Activation checks. To keep a license to one Mac, Wave X checks the key with Polar when you activate it and about once a week afterwards. The Privacy Policy describes what these checks send. A check that can’t connect never turns Pro off.
Wave X remains our property and that of our licensors. You buy a license to use it, not the software itself.
3. What Pro includes
Pro includes these features, as described on the Wave X website when you buy:
- Lock screen sync: the lock screen shows the same wave as the desktop and follows it, using movies Wave X makes on your Mac.
- Accent and icon matching: your Mac’s accent color, highlight color and tinted icons follow the wave.
- Pointer matching: the pointer takes on the wave’s colors.
- Your own Colors: making and editing your own Colors.
- Showing a Color while a Focus is on, and Wave X actions in Shortcuts and Spotlight.
Everything else in Wave X is free. Wave X requires a Mac with Apple silicon and macOS Tahoe 26 or later. Beta versions of macOS aren’t supported.
4. Features that rely on undocumented macOS behavior
Some Pro features (lock screen sync, accent and icon matching, and pointer matching) rely on macOS behavior Apple does not publicly document. A macOS update can change or stop those features. We may not be able to restore compatibility in every case. If a Pro feature stops working, we will say so on the Support page and work on a fix. Your rights under section 5 and under consumer law still apply.
5. Refunds
To request a refund within 14 days, email support@wavex.live with your order number. You get a full refund, including any tax you paid for Pro. You don’t need to give a reason; optional feedback helps make Wave X better. Refunds are processed through Polar. Your statutory consumer rights are not affected.
Requests after 14 days may be considered under this policy; this does not limit rights that cannot legally be excluded.
After a refund, the license key stops working. Pro turns off on your Mac when Wave X next runs and completes its online license check. That is normally within a week, but later if the Mac is offline or Wave X isn’t running. When Pro turns off, Wave X restores the settings it changed and removes its lock screen tiles (section 6).
6. Changes Wave X makes to your Mac
With your permission, Wave X Pro can change your accent color, icon tint, pointer colors and lock screen wallpaper. Wave X asks before it first makes each of these changes, and you can turn each feature off in Wave X. Wave X also keeps its own files on your Mac (such as the lock screen movies it makes) and adds its own tiles to Wallpaper settings.
When you turn a feature off, quit Wave X normally, or Pro ends, Wave X tries to restore the setting it recorded before it made the change. A crash, a forced quit, deleting Wave X while a feature is on, or a macOS update can prevent a full or immediate restore. Before you delete Wave X, turn off accent, icon and pointer matching and choose Settings › Lock Screen › Remove All Wave X Tiles…. The Support page explains how to clean up if Wave X was deleted first.
7. Updates
Wave X can check for updates once a day while “Check for updates automatically” is turned on. You can turn off automatic checks or check manually. Updates install automatically only if you turn on “Download and install automatically”, and then the next time Wave X quits; otherwise you choose when to install. Each update has release notes. We will describe any material change to Pro, such as a feature that stops working or is retired, in the release notes and on the Support page before or when it ships.
We support the current version of Wave X on the macOS versions listed in section 3. When a new major version of macOS comes out, we will say on the Support page which versions of Wave X support it.
8. Fair use
Please don’t share, sell or publish license keys, get around activation, or use Wave X to break the law. If a key is abused this way, we may deactivate it after telling you why and giving you a chance to respond. This doesn’t affect any right you have to repair or replace your own Mac, or other rights you have by law.
9. Warranty
We make Wave X with care, but we can’t promise it will be free of errors or work on every Mac. To the extent the law allows, Wave X is provided “as is”, and we exclude warranties not stated in these terms. If you are a consumer, you keep the statutory rights your country gives you, for example that digital content is as described and of satisfactory quality; these terms don’t limit them.
10. Liability
To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of data you could have avoided by keeping a backup, and our total liability to you is limited to the greater of the amount you paid for Pro and US$50. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or willful misconduct, or any other liability that the law doesn’t allow to be limited or excluded.
11. Other software and our trademarks
Wave X includes open-source software and fonts under their own licenses, listed on the Licenses page and in Wave X › About Wave X. Each of those licenses applies only to the software or font it names. None of them grants rights in any third party’s trademarks, artwork or other material. “Wave X” and the wave mark are our trademarks; don’t use them in a way that suggests we endorse something we don’t.
12. Changes to these terms
The version at the top shows the current terms. We will give notice of a material change on this page before it takes effect, and in the release notes of the next version of Wave X. A change never applies retroactively to a purchase you already completed: the terms shown when you bought Pro apply to that purchase, unless you agree otherwise or the law requires a change. Earlier versions are available on request.
Prices may change for future purchases. A price change does not affect a completed purchase or its license. The price shown before you place your order applies to that purchase.
13. Law and disputes
If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring a claim in its courts. Before starting any formal dispute, please email us so we can try to fix it.
